Rosina Emma Conditions of Hire
 
  1. HIRE FEE. The Hire Fee covers the hire of the boat and a full inventory of navigational and domestic items. This includes bedding and towels. Diesel fuel and bottled gas is included in the Hire Fee. The boat is licensed for navigation on British Waterways’ rivers and canals and the River Thames on request. The Hirer will be responsible for the cost of any additional water supply and for toilet pump-out charges that may arise during the course of the Hire Period.

    2. BOOKING. A boat is not booked until the completed and signed Booking Form, together with a deposit of 25% of the total hire fee, has been received by Kennet Cruises and confirmed in writing.

    3. BALANCE OF HIRE FEE. The balance of the Hire Fee will be invoiced for payment to be made not loater than 28 days rior to the commencement of the Hire Period.

    4. CANCELLATION. Should the Hirer cancel the booking we shall endeavour to re-let the boat, but if we are unsuccessful the Hirer remains responsible for the balance of the Hire Fee. I the boat is re-let an administrative charge of 10% of the Hire Fee will be made in any event.

    5. HIRERS. Bookings cannot be accepted from persons under 21 years of age. We reserve the right to refuse to hand over a boat to an person who in our opionion is not suitable to take charge. In this event all money will be refunded in full and the Hirer shall have no further claim.

    6. INSURANCE. Insurance of the boat and equipment and the Hirer’s liability to other parties, excluding the first £50 of any claim, is included in the Hire Fee. A sum of £50 must be deposited before the start of your cruise. Provided no loss or damage has occurred this will be refunded at the end of the Hire Period. All repairs and replacement of lost or damaged equipment is the responsibility of Kennet Cruises and substitutes cannot be accepted from the Hirer.

    7. HIRE PERIOD. ‘Rosina Emma’ is available on a Daily basis from 0830 hrs to 1700 hrs.For Perid Hire the Hire Period starts at 0830 hrs on the first day and ends at 1700 hrs on the last day. For Period Hire, If the boat is available, a handover can be arranged from approximately 1930 hrs on the evening prior to the Hire Period at no extra charge. Variation of the Hire Period may be possible by prior negotiation.

    8. HANDOVER & RETURN OF BOAT. On taking over the boat the Hirer should that everything is in order. After a briefing and demonstration run, the Hirer will be responsible for the safe operation of the boat and the security of its equipment. The boat must be returned at the scheduled time at the end of the Hire Period in a CLEAN CONDITION. We reserve the right to make a charge if the boat is returned dirty or late.

    9. HIRER’S RESPONSIBILITY. The Hirer is in complete charge of the boat and is responsible for its safe navigation. The only maintenance to be carried out is checking the engine oil and water levels, lubricating the stern tube and clearing weed hatches. Children must not handle the boat without supervision. The Hirer shall at all times comply with the bye-laws of British Waterways or other appropriate Navigation Authority. The Hirer is responsible for any claim made for loss of water or damage by improper use of lock paddles, moveable bridges or other apparatus and for any claim made for damage ddue to excessive speed or improper navigation. The maximum number of passengers permitted on the boat is 12. This is a leal requirement and the carriage of more than 12 passengers could result in heavy fines for the Hirer. The boat may not cruise between the hours of Sunset and Sunrise. The Hirer shall not enter tidal waters or tow other vessels. The Hirer shall not navigate the boat under flood conditions. Firearms, portable gas- or petrol-fuelled apparatus will not be allowed on board under any circumstances. Requests for the carriage of canoes or bicycles must be made to Kennet Cruises prior to the Hire Period. In the event of an accident the Hirer must promptly notify Kennet Cruises with full details and names and addresses of witnesses. DO NOT admit liability under any circumstances.

    10. DELAYS OR RESTRICTIONS. Kennet Cruises cannot be held liable for any delays or non-fulfillment of bookings caused by breakdowns, unforseen defects, obstructions, water shortage,, diesel shortage, repairs or damage to the boat or the waterway system. If unusual conditions arise we reserve the right to restrict the cruising area without notice. If we are unable to provide the boat booked or a suitable alternative, we will refund all money paid in full and the Hirer shall have no further claim.
